Johnson Janklow Abdallah Secures Appellate Victory for East Side Church

Johnson Janklow Abdallah is pleased to announce that the South Dakota Supreme Court has ruled in favor of one of the firm's clients, East Side Lutheran Church of Sioux Falls, in a dispute with the church's architect and general contractor that oversaw the construction of its recent addition and renovation.

The Supreme Court's unanimous decision reversed a decision by the lower court and remanded the case so that the Church could proceed to trial on its claims arising from defects in the construction.

"We reverse the circuit court," the decision explained, "holding that a trier of fact must determine whether any or all of East Side's design error and construction error claims accrued at the time of actual notice of the water infiltration."

Attorney Ron Parsons, head of Johnson Janklow Abdallah's Appellate Department, successfully argued the case for East Side Lutheran Church.
